What rules WXYZ and other television stations must follow for political advertising

SOUTHFIELD, Mich. (WXYZ) — You've probably seen all the political ads running on 7 News Detroit and other television stations in the Detroit metro area. As the November general election approaches, these ads will continue to run.

Over the last few months, we've heard from many people asking questions about why different ads are being shown. WXYZ must follow rules set by the Federal Communications Commission.

The FCC sets rules for political advertising when it comes to pricing, equal time and content.

Under federal law, “broadcasters are prohibited from censoring or rejecting political ads paid for and sponsored by legally qualified candidates.”

According to the FCC, a person is a “legally qualified candidate” if he or she meets the following criteria:

  • “has publicly announced his intention to run for office;
  • is qualified to hold the position sought under applicable state and/or federal law; AND
  • qualified for a place on the ballot or stood as a candidate and has clearly demonstrated his/her candidacy.
    • A person running as a candidate must not only meet the first two criteria, but also provide a “substantial achievement,” i.e. give campaign speeches, distribute campaign literature, issue press releases, lead a campaign committee, set up a campaign headquarters, use social media to promote their candidacy and create a campaign website. Not all of the activities listed are absolutely necessary to provide essential evidence.”
